Starbucks wins China trademark lawsuit

DBR Staff Writer Published 03 January 2006

US coffee giant Starbucks has won a landmark case against a Chinese company which opened a chain of coffee shops under the name Xingbake - Chinese for Starbucks.

The Chinese court ordered Shanghai Xingbake to stop using its name, to pay RMB500,000 ($62,000) in compensation to Starbucks and to issue an apology in a local newspaper. The judgment is being regarded as a sign that China, which is the source of 70% of the world's pirated goods, is responding to pressure from the US and EU to crack down on intellectual property rights infringements. In a similar occurrence last month, the owner of 'Sambucks' coffee shop in Oregon, was told by a federal judge that the name was too similar to that of the coffeehouse giant and had to be changed. This most recent case is the first to involve a foreign language translation of the Starbucks brand name.
